Section 11 (2) of the Care Standards Act 2000 has been repealed
Section 11 (2) of the Care Standards Act has been repealed. An additional section has been added in its place to compensate.
The effect of the repeal means that:
- There is no change to Care and Social Services Inspectorate Wales' (CSSIW) ability to enter and inspect premises (including branches) of agencies in Wales, whether or not they operate from one office, or from two or more branches.
- As previously, if the principal office of an agency is in England but the agency has one or more branches situated in Wales, the branch(es) in Wales must be registered in Wales and inspected by the registration authority in Wales (i.e. CSSIW or Healthcare Inspectorate Wales).
- The exception to the above is the law as it relates to voluntary adoption agencies.
- In the case of voluntary adoption agencies there is not, and never has been, a requirement for seperate registration of branches.
