NHS Redress (Wales) Measure 2008

This Measure was introduced on 2 July 2007 by the Minister for Health and Social Services. It was passed by the National Assembly for Wales on the 6 May 2008 and approved by Her Majesty in Council on 9 July 2008.

What is the purpose of the Measure?

To allow Welsh Ministers to make regulations for the NHS in Wales so that they can settle certain clinical negligence claims locally without the need for legal action.

It sets out the main areas that will be covered by Regulations, including what NHS Redress will be comprised of, the situations in which it may apply, and the support that people using the system can expect to receive.

What are the benefits of the Measure?

It aims to ensure that NHS patients will receive fairer and more equal access to compensation, where appropriate, without the need for legal action.  It fits within a wider piece of work looking at how the NHS in Wales handles and investigates concerns.
