Tenancy Deposit Protection

Ensuring tenants' deposits are handled fairly.

When a landlord or letting agent takes a deposit from a tenant, the deposit must be protected in a government-authorised Tenancy Deposit Protection Sheme.

The Tenancy Deposit Protection Scheme commenced in April 2007.  The idea of the scheme is that:

  • when tenants are entitled to it, they get all or part of their deposit back;
  • any disputes between tenants and landlords or agents will be easier to resolve; and
  • tenants are encouraged to look after the property they are renting.

Tenants should ask their landlord about the details of the scheme when signing a new tenancy agreement.
